The Ministry of Foreign Affairs (MFA) of Ukraine stated that they expect in 2-3 weeks the decisions of the UN International Tribunal on the Law of the Sea on the claim of Ukraine to Russia on the application of temporary measures, which consist in the release and return of captured Russian sailors to Russia.
This was stated by the press secretary of the Ukrainian Foreign Ministry Kateryna Zelenko, reports RBK-Ukraine.
The speaker recalled that on May 10 in Hamburg open oral hearings will be held on the case of the immunities of three Ukrainian warships and 24 members of their crews illegally seized by the Russian Federation on November 25, 2018.
“During the hearings, the delegation of Ukraine will present its position on the request for the application of temporary measures that were sent to the International Tribunal for the Law of the Sea on April 15 of this year,” said Zelenko.
It is noted that on behalf of Ukraine, Olena Zerkal, the Deputy Minister for Foreign Affairs, as well as a professor in international law and representatives of the law firm Covington & Burling LLP will act as an agent.
“The delegation will appeal to the International Tribunal demanding to oblige the Russian Federation to immediately release the naval vessels and their crews, since the vessels and military personnel have immunity in accordance with the UN Convention on the Law of the Sea cannot be legally detained, held and tried by the Russian Federation”, – declared Zelenko.
It is also emphasized that “although the Russian Federation refused to participate in oral hearings, this does not affect the legitimacy of the process at all.”
As reported by the Journalist, the lawyers appealed the decision of the Russian court to extend the arrest of Ukrainian sailors of prisoners of war.
