Ukraine adopts Law on war crimes in Donbas, which have no statute of limitations

The Verkhovna Rada of Ukraine has adopted in the first reading a draft law No. 9438 “On Amendments to Certain Legislative Acts on Ensuring the Harmonization of Criminal Legislation with the Provisions of International Law”.

This decision was backed by 228 deputies. Voting was repeated several times until law received necessary support.

The Deputy Minister of Justice for European Integration Serhiy Petukhov presented the draft law to the deputies and noted that this bill for the first time introduces the modern concept of a war crime into Ukrainian legislation, as well as the concept of a crime against humanity.

Some of these crimes are described in the current Criminal Code by one article, the sentences on them are almost not imposed previously. The adoption of these amendments will allow to bring to justice those who have committed crimes against people in Eastern Ukraine, despite the statute of limitations.

The deputy minister stressed that the people who committed such crimes cannot be amnestied.

These changes regards grave and particularly serious crimes committed in the temporarily occupied territories of Ukraine, the statute of limitations is suspended from the moment of the commission of such crimes. In these cases, the limitation period shall be resumed from the day the person appeared with the confession, his arrest or from the moment of official de-occupation of the relevant territory.
