On Wednesday, January 16, President of Ukraine Petro Poroshenko signed the law on Amendments to Certain Legislative Acts of Ukraine Regarding Counteracting Bullying (Harassment). This was published on the website of the Verkhovna Rada of Ukraine.
The law provides administrative responsibility for bullying: from now on not only the perpetrators themselves will be punish with fines, but also the leadership of the educational institution, for untimely reporting to law enforcement agencies of cases of harassment.
The Code of Ukraine on Administrative Offenses was amended by Article 173-4 and provides a fine of fifty to one hundred non-taxable minimum incomes of citizens, or public works for a period from twenty to forty hours for bullying, committed to a minor person or by such a person in relation to other participants of the educational process, as a result of which the victim’s mental or physical health was or may have been injured.
If the harassment was carried out by a group of persons repeatedly within a year after the imposition of an administrative penalty, the next penalty will be from one hundred to two hundred non-taxable minimum incomes of citizens or public works for a period of from forty to sixty hours.
The law prescribes punishment for harassment committed by minors between the ages of 14 and 16 by imposition of a fine on parents or persons replacing them, from fifty to one hundred non-taxable minimum incomes of citizens or community work for a period of twenty to forty hours.
The law also provided imposition of a penalty of fifty to one hundred non-taxable minimum incomes of citizens or corrective work for up to one month with deduction of up to 20% of earnings to the head of the institution who failed to inform the authorized police departments about cases of bullying (harassment).
