Stanislav Kutsenko: in Kiev in favor of children were recovered almost UAH 114 million of alimony since the beginning of the year

The Verkhovna Rada of Ukraine will vote on the second package of laws «Сhildren cannot be strangers» tomorrow.

Some 118,000 non-payers of alimony are restricted in Ukraine, – The Head of the Main Regional Office of Justice in Kyiv Stanislav Kutsenko told in his interview to «The Journalist».
In particular, bans to go abroad, to drive a car, to use weapons, prohibiting hunting. Almost 19 thousand protocols have been drawn up on the appointment of community service works.
The courts issued 1,088 relevant decrees. More than 9 thousand non-payers are put on wanted list.
In addition, a register of non-payers who do not pay alimony for more than 3 months has been opened. Almost 200,000 debtors have been added to the register.
According to Kutsenko, the «Board of Shame» of non-payers of alimony was promulgated in each region

«Several groups of performers have been formed, who will focused on the implementation of court proceedings, specifically on the payment of alimony. Also they will monitor the execution of decisions on recovery of alimony, carried out by government executive bodies», – said the head of the Kyiv Justice Department.

Mr Kutsenko said, that the story about the Ferrari car owner, who had ignored the judicial orders and did not give a penny to his child, despite the fact that he have money and he live in luxury accommodations, became widely known

«Now an expensive car is confiscated. In the near future, it will be sold by our «OpenMaket» trade system of the seized property. The funds will be used to pay off the debt to the child, – said Stanislav Kutsenko. – Literally, last month we had another situation, which was really impressive. In Kiev, thanks to the action of the first package of law, person pay off long-term debts, which reached UAH 2 million 176 thousand! Can you just imagine how huge is this amount is?. That is, the so-called father, having a lot of money, simply ignored the interests of his own child. And he would had do the same in the future, if sanctions imposed by our executors did not force him to pay debts».

The second package of draft laws (№8296) «Сhildren cannot be strangers» is under consideration in the Verkhovna Rada of Ukraine.

Stanislav Kutsenko named the following key innovations, included in the bill:

• A system of additional financial sanctions for non-payers in the amount of 20% to 50% of the total debt amount (depending on the term of the debt).
• The system of automated arrest of non-payer’s funds, who have debts for the payment of alimony.
• Attraction of persons, who are evading socially useful people, to criminal liability.
• To compel convicts to work in order to ensure the payment of alimony.
• Ukrainians, who want to occupy leading positions in the civil service, will have to present a certificate stating they have no debts to their children for more than 6 months.
• Dismissal of officials who have debts for the payment of alimony for more than 12 months.
• Exemption of children from the duty to support incapacitated parents who did not pay alimony for more than 3 years.
• Applying the limitations of the first package of the law against parents, who do not pay children with disabilities or severely ill after their debt exceeds the amount for 3 months.
• The introduction of the child’s departure abroad for up to 1 month with the parents the child lives with.
• Simplification of the order of the child’s departure abroad with the parents who live separately, but conscientiously fulfills their parental responsibilities.
• increase the level of the minimum upkeep of the child to the subsistence level to those parents, who do not live with the family.
• the right to leave without pay for those parents who cares about a seriously ill child.
• enrollment in the work experience the period of care for a seriously ill child.
• Benefits and preferences for parents who conscientiously fulfill their parental duty, spend additional funds on courses, training, sports and any other sections.
• Financial incentives for local authorities, who are engaged in training of children, develops children’s spaces.
• Abolition of taxation of alimony from non-resident parents.
• a person who conscientiously pay alimony, will receive additional guarantees to control the expenditure of the paid funds.
• There are sanctions for those of the parents, who spend money not on the needs of the child.
• A conscientious payer receives additional guarantees to realize his right to see the baby and participate in his upbringing.
