Presidential representative believes Ukrainian military will not be tried in The Hague

The permanent representative of the President of Ukraine in Crimea Anton Korynevych has said that the International Criminal Court will not bring charges against the Ukrainian military, since Ukraine independently and effectively investigated the crimes of its military personnel committed during the conflict in Donbas, reports RBC-Ukraine.

According to him, one of such examples is the case against the soldiers of the Tornado special company, which was investigated by Ukrainian law enforcement officers.

“Therefore, I think that these will be cases of flagrant violations by the Russian Federation and separatists. Why? Because the Ukrainian justice cannot reach these people,” Anton Korynevych said.

At the same time, his predecessor in this position, lawyer Borys Babiy, is convinced that there will be no criminal cases against the Ukrainian side. However, there are significant gaps in Ukrainian legislation that could theoretically lead to problems in international courts.

In his opinion, besides the ratification of the regulations, it is necessary to urgently amend the Criminal Code. In particular, introduce responsibility for military aggression and crimes against humanity, as well as regulate the rules for the treatment of prisoners of war.

“The question is whether Ukrainian combatants, security forces, representatives of the Armed Forces of Ukraine, and officials carried out the crimes described in the Rome Statute. This will be decided not by the Basmanny Court of Moscow, but by The Hague Court, and as an international lawyer I am 98% calm about this, because I do not see the corpus delicti in their [representatives of Ukraine – ed.] actions,” he emphasized.
