The Verkhovna Rada of Ukraine has adopted in the second reading the draft Law of Ukraine “On the provision of construction products on the market”, which implements the provisions of EU Regulation No. 305/2011 in Ukraine, the Ministry of Community and Territorial Development reports.
EU regulation No. 305 establishes uniform conditions for the member states for the placement of construction products in order to create a single economic space on the territory of the European Union and prevent products and services from entering the internal markets of its members that may pose a threat to human life and health and harm the environment.
“The draft Law was adopted in the result of the consolidation efforts of the legislative and executive branches of power. After all, the draft Law was developed by the people’s deputies together with the central executive authorities with the involvement of a wide range of specialists, experts, scientists, manufacturers of construction products, technical committees for standardization, and so on. The implementation of the provisions of the Law will allow to overcome the problem of mass counterfeiting of construction products in the Ukrainian market to ensure effective market supervision over the quality of construction products, to create conditions for free circulation of construction products in the market of Ukraine and the EU, to “unblock” the entry of domestic manufacturers to the European building materials market and to increase attraction for international investment in Ukraine,” the first deputy minister of development of communities and territories Vasyl Lozinsky said.
The implementation of the Regulation in the national legislation of Ukraine is a prerequisite for the conclusion of the Agreement on the Assessment of Conformity and Acceptability of Industrial Products (ACAA), which will grant access for industrial products to the markets of Ukraine and EU countries.

To protect consumers from substandard hazardous construction products, state market supervision authorities will apply measures to restrict, ban, withdraw from circulation and / or recall products that do not meet the established requirements.
In addition, the bill establishes the basic requirements for buildings and structures in terms of safety, health care, durability, energy conservation, environmental protection throughout its entire life cycle – from design to dismantling.
It is planned that the new system for the provision of construction products on the Ukrainian market in full, will work in 2023 after the development and adoption of the relevant regulatory legal acts. According to an average estimate, these are about several dozen documents.
