Yuriy Vitrenko, Executive Director of NJSC Naftogaz of Ukraine said that Ukraine has won an appeal on Gazprom’s first complaint against the decision of the Stockholm arbitration.
“Complete victory! Ukraine is winning again! We won the appeal on the first complaint of Gazprom against the decision of the Stockholm arbitration!” Vitrenko said.
According to Vitrenko, the decision of the Svea Court of Appeal in Stockholm (Sweden) states:
1. The Court of Appeal rejects Gazprom’s complaint;
2. Gazprom must compensate Naftogaz for the costs of litigation in the amount of EUR 1,021,774.26 and UAH 1,650,000, of which UAH 1,000,000 are legal expenses, and pay interest in accordance with Section 6 of the Interest Act for these two above amounts from the moment the court ruling takes affect and until payment is made;
3. The Court of Appeal rejects Gazprom’s request for compensation for the costs of the lawsuit;
4. The Court of Appeal rejects Gazprom’s appeal for secrecy.
“The court decision cannot be appealed,” Vitrenko emphasized, wondering, “what other evidence is needed to prove that our claims are not ‘absurd’, and the Stockholm arbitration decisions are well-founded and must be implemented by Gazprom?”
