Ukraine’s Supreme Court recognized lustration of ex-head of the commission of judges as illegal

The Supreme Court of Ukraine, as part of the Cassation Administrative Court, has recognized the lustration of the former Chairman of the Supreme Qualifications Commission of Judges, Ihor Samsin, as illegal. This is stated in the press service of the Supreme Court.

«The court satisfied the plaintiff’s claims and found illegal and canceled the decision of the High Council of Justice of April 25, 2017, No. 988/0/15-17, on recognizing the violation by the judge of the Supreme Court of Ukraine of incompatibility and dismissal requirements. The court also reversed the decision of the Supreme Council of Justice of May 23, 2017 No. 1223/0/15 /-17 on the abandonment of the plaintiff’s application for dismissal of the Supreme Court judge of Ukraine,» – the statement said.

According to the report, the board of judges found a violation of the principle of proportionality, because in this case interference in the rights of the individual (dismissal of the plaintiff on the basis of violation of the requirements for incompatibility) does not justify the purpose of the lustration process.

The decision can be appealed in the Grand Chamber of the Supreme Court.
